1. Acceptance of Terms

By downloading, installing, or using Swifty Workouts ("the App"), you acknowledge that you have read, understood, and agree to be bound by these Terms & Conditions. If you do not agree to these terms, you must not use the App.

2. Description of Service

Swifty Workouts is a fitness tracking application for Apple Watch that enables users to:

  • Create and save named workout routes
  • Record and monitor workout metrics including time, distance, pace, calories, and heart rate
  • Track live GPS route maps drawn in real-time during workouts
  • Receive mile and kilometer marker audio announcements with current pace
  • Set distance, time, or combined goals with real-time pace feedback
  • Compare every workout against your personal average for that route
  • View progress over time including personal bests and weekly activity
  • Integrate workout data with Apple HealthKit
  • Track workouts independently without an iPhone present

3. Supported Workout Types

Swifty Workouts supports the following workout types: Walking, Running, Cycling, Hiking, Swimming, Skiing, Rowing, Skating, Cross Country Skiing, Snowshoeing, Paddle Sports, Wheelchair Walk Pace, and Wheelchair Run Pace.

Note: Swimming workouts are designed for indoor lap pools only.

4. Health Disclaimer

Swifty Workouts is provided for general fitness and informational purposes only and is not a substitute for professional medical advice, diagnosis, or treatment.

You should consult a qualified healthcare professional before starting any exercise program, particularly if you have a medical condition or history of health concerns.

If you experience pain, dizziness, or discomfort during use, discontinue your workout immediately and seek medical advice.

Data displayed in the App may not be completely accurate and should not be relied upon for medical purposes.

5. User Responsibilities

When using the App, you agree to:

  • Use the App at your own risk
  • Ensure your Apple Watch is correctly worn, paired, and functioning
  • Exercise safely, follow local laws, and remain aware of your surroundings
  • Accept full responsibility for any injuries or damages resulting from your use of the App

6. Intellectual Property

All content, features, and functionality of Swifty Workouts, including its name, design, and code, are the exclusive property of the developer and are protected by applicable copyright, trademark, and other intellectual property laws.

7. User-Generated Data

Workout routes and data you create remain your property and are stored locally on your devices only. We do not access, collect, or claim ownership of your data.

8. Limitation of Liability

The App is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind. To the maximum extent permitted by law, the developer shall not be liable for:

  • Direct, indirect, incidental, or consequential damages
  • Personal injury or property damage arising from your use of the App
  • Data loss or inaccuracies in recorded workout information
  • Service interruptions or software errors

9. Indemnification

You agree to indemnify, defend, and hold harmless the developer from any claims, damages, or liabilities arising from your use or misuse of the App.

10. Modifications to the App

We reserve the right to modify, suspend, or discontinue the App at any time, and to update these Terms & Conditions without prior notice.

11. Termination

You may terminate these terms at any time by uninstalling the App. We may suspend or terminate access to the App without notice for any reason, including violations of these Terms & Conditions.

12. Governing Law

These Terms & Conditions shall be governed by and construed under the laws of the State of Illinois, USA without regard to its conflict of laws principles.

13. Entire Agreement

These Terms & Conditions constitute the entire agreement between you and the developer regarding the use of Swifty Workouts.

15. Apple-Specific Terms

  • These Terms & Conditions are between you and the developer only; Apple Inc. is not a party to them.
  • Apple is not responsible for maintenance, support, or any claims relating to the App.

Swifty Workouts – Privacy Policy

1. Overview

Swifty Workouts ("the App") is designed with a privacy-first approach. We do not collect, store, or share your personal information.

2. Information Collection and Use

Swifty Workouts:

  • Does not collect personal data
  • Uses location data only during active outdoor workouts to track routes and distance
  • Does not track your location outside of workouts you initiate
  • Does not transmit data to external servers
  • Does not share information with third parties
  • Does not require an account or login
  • Does not use analytics or advertising tools

3. Background Location Tracking

During active workouts, Swifty Workouts uses background location tracking to ensure continuous GPS route recording even when your Apple Watch screen is off or your wrist is lowered. This is achieved using Apple's allowsBackgroundLocationUpdates feature in combination with an active HealthKit workout session.

Background location tracking:

  • Is only active during a workout you have explicitly started
  • Stops automatically when you end your workout
  • Is never used outside of an active workout session
  • Does not run in the background at any other time

4. HealthKit Integration

The App integrates with Apple HealthKit solely to:

  • Read workout data such as heart rate, calories, and distance
  • Write workout summaries to the Health app
  • Track location during outdoor workouts for route mapping All HealthKit data stays on your device and within Apple's Health ecosystem. We never view, store, or transmit this information.

5. Data Storage

All workout routes and metrics are stored locally on your Apple Watch and iPhone only. This data remains entirely under your control.

6. Location Data

For outdoor workouts, the App uses your device's GPS to:

  • Track workout routes and distance in real-time
  • Calculate pace and draw live route maps
  • Save route maps to your Health app
  • Continue tracking even when the Apple Watch screen is off Location data is used only during active workouts and is stored locally in HealthKit. We do not access or store location data outside of workout sessions.

7. Audio Announcements

Swifty Workouts provides optional audio announcements at mile and kilometer markers during workouts. These announcements are delivered through your Apple Watch speaker or routed to your iPhone speaker and AirPods when your iPhone is nearby. No audio data is recorded or transmitted.

8. WatchConnectivity

The App uses Apple's WatchConnectivity framework to send live workout data between your Apple Watch and iPhone companion app. This data transfer occurs only between your own devices and is never transmitted to external servers.

9. Third-Party Services

The App does not integrate with or share data with any third-party services.

10. Children's Privacy

The App does not knowingly collect data from children under the age of 13.

11. Subscription Data

Swifty Workouts offers optional paid subscriptions processed entirely through Apple's App Store. We do not collect, store, or have access to any payment information. Subscription management is handled exclusively by Apple.

12. Changes to This Privacy Policy

We may update this Privacy Policy periodically. Any changes will be reflected with a revised "Last Updated" date at the top of this page.
